General Terms and Conditions (GTC) of Bohnendealer GmbH:

 

§1 Applicability to consumers and entrepreneurs and definitions

(1) The following GTC apply to all orders placed on acht.coffee by consumers and entrepreneurs. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity. These terms and conditions also apply to future business relationships with entrepreneurs without us having to refer to them again. If the entrepreneur uses conflicting or supplementary terms and conditions, their validity is hereby rejected; they will only become part of the contract if we have expressly agreed to them.

§2 Conclusion of a contract, storage of the contract text

(3) The presentation of goods in our online shop does not constitute a legally binding contractual offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

(4) Upon receipt of an order in our online shop, the following provisions apply: The customer submits a binding contractual offer by successfully completing the ordering procedure provided in our online shop.

The order is placed in the following steps:

1) Select the desired goods.
2) Confirm by clicking on the “Order” button.
3) Check the details in the shopping cart.
4) Click on the “Checkout” button.
5) Log in to the online shop after registering and entering your login details (email address and password).
6) Check and correct the information you have entered.
7) Submit your binding order by clicking on the “Place order” or “Buy” button.

 

Before submitting a binding order, the consumer can return to the website where the customer's details are recorded and correct any input errors by clicking the “Back” button in the Internet browser they are using, or cancel the order process by closing the Internet browser. We will immediately confirm receipt of the order by means of an automatically generated email (“order confirmation”). With this, we generally accept your offer. However, the contract only comes into effect when the goods are shipped.

(5) Storage of the contract text for orders via our online shop: We store the contract text and send you the order details and our terms and conditions by email. You can also view the terms and conditions at any time at https://www.bohnendealer.at/policies/terms-of-service. You can view your past orders in your customer area under Account --; My order history.

§3 Prices, shipping costs, payment, due date

(1) The prices quoted include statutory sales tax and all costs for payment service providers. Any shipping costs will be added. Information on shipping conditions can be found here: https://www.bohnendealer.at/policies/shipping-policy

Payment is due immediately upon placing the order.

(2) Consumers have the option of paying by PayPal, credit card (Visa, Mastercard, via the payment service provider Stripe).

The following applies in this regard:

PayPal, PayPal Express: During the ordering process, you will be redirected to the website of the online payment service provider PayPal. To do this, you must be registered with a PayPal customer account and log in to PayPal with your access data or, if you do not yet have a customer account, create one. Once you have placed your order in our online shop, PayPal will receive our request to initiate the payment process. You will receive all further information on their website when you make your payment. The transaction is then carried out automatically by PayPal.

Credit card payment via Stripe: During the ordering process, you will be redirected to the website of the online payment service provider Stripe. Here, you will enter your credit card details on Stripe. Stripe will then request your credit card company to carry out the payment transaction. Your credit card will be charged automatically by the credit card company.

 

§4 Retention of title

We retain title to the goods until the purchase price has been paid in full.

§6 Place of performance for B2B transactions

The place of performance for services under the contract is our registered office. This does not apply to any consideration. In this case, the registered office of the performing company shall be deemed the place of performance.

§7 Applicable law, place of jurisdiction

Austrian law applies. The UN Convention on Contracts for the International Sale of Goods is expressly excluded. For contracts with entrepreneurs, the court with jurisdiction at the registered office of our company has local jurisdiction. However, we also have the right to bring legal action at the general place of jurisdiction of the contractual partner.

 

§8 Disclaimer

Our company is only liable for damages in cases of intent and gross negligence. This does not apply to personal injury or consumer transactions. The existence of slight or gross negligence must be proven by the injured party, unless it is a consumer transaction. Compensation for consequential damages (due to defects), as well as other property damage, financial losses, and damages to third parties against the customer, unless it is a consumer transaction, is excluded.
The warranty must be claimed from the guarantor (the manufacturer/sometimes also the seller, if they are the manufacturer) and is subject to their terms and conditions. Please refer to the contract confirmation for any warranty conditions. The statutory warranty is not limited by the assertion of the warranty.
When shipping goods in consumer transactions, the risk of loss or damage to the goods is only transferred to the consumer as soon as the goods are delivered to the consumer or to a third party designated by the consumer, other than the carrier. However, if the consumer has concluded the contract of carriage themselves without using a selection option proposed by us, the risk is transferred to the carrier as soon as the goods are handed over to the carrier.

§9 Contract language

The contract language is exclusively German.
